This privacy policy (“Privacy Policy”) is designed to help you understand how Khadduri Legal Consulting (“KLC,” “we,” “us,” “our firm”) collects, uses, and shares your personal information and to help you understand and exercise your privacy rights.

This Privacy Policy applies to personal information processed by us on our website www.khaddurilegalconsulting.com (“Website”) and related services. By visiting our Website or accessing our services, you are agreeing to the terms of this Privacy Policy. This Privacy Policy is incorporated by reference into the KLC Terms of Use or other agreement governing the use KLC services.

KLC is committed to respecting and protecting your privacy, confidentiality, accuracy, and security that may be in our possession. We comply with the Canada Personal Information Protection and Electronic Documents Act (“PIPEDA”), the Law Society of Ontario’s Rules of Professional Conduct, and the local governing laws applicable in the various provinces in which we operate. KLC’s compliance applies to all partners, employees, contractors, and agents in providing legal services to our clients. Therefore, any personal data in our possession or that we collect is protected by solicitor-client privilege.

Capitalized terms not otherwise defined in this Privacy Policy shall l have the meaning ascribed to them in the KLC Terms of Use.

Personal Information

We, our contractors, and third-party hosts/platforms, may collect and store any information you choose to put in an e-mail, contact form, or comment you send us (or them) or to set up an account (e.g., name, e-mail address, telephone number, mailing address). Our Website does not collect or store full payment information (but may store partial, truncated credit card numbers), for which you will be directed to a payment contractor. We, and/or our contractors, also collect data on how our Website is used and its/their visitors/users: for example, number of page visits and duration, type of browser, visitors’ devices’ Internet Protocol (“IP”) addresses (which include general location). Some “usage data” comes through “cookies” (basically small data files sent to your device when visiting our Website) and other technologies (we’ll refer to them collectively as “cookies” for convenience), as described below. Our Website is not meant to collect information that may be considered “sensitive” (as various jurisdictions may use the term), nor any personal information from anyone under age 18.

Use of Personal Information

KLC may collect, disclose, or use Personal Information for the following reasons:

To person conflict of interest searches and determine whether KLC can or will enter into a professional relationship with you;
To exercise, to our best ability, client communication;
To provide services to you and others, if applicable or retained;
To provide legal advice to you, others, and our clients and provide legal representation for you and others in a transaction if retained as our client;
To perform our administrative responsibilities;
To maintain information about potential employees or clients;
To collect and use the Personal Data of our employees for administration purposes;
For the use of legal precedents;
For billing and accounting services relating to KLC’s services;
To send and advise you, our clients, and others of our courses, notices, seminars, special events, conferences, and newsletters, and to make them aware of our legal services;
To send and communicate with you and others to send greetings, gifts, and cards from our firm;
For any other reasons for which we have your consent;
For other purposes as permitted or required by applicable laws and regulations, including but not limited to complying with legal and regulatory requirements such as Anti-Money Laundering;
To gather and review evidence that is relevant to legal issues affecting our clients or us; and
Any other reason that may be required and is permitted by law.

As do most websites, ours uses cookies. Some are necessary for the Website to operate, others we use to help improve and secure our Website, others help us learn about and market to our visitors. If you visit our Website from outside of Canada, we expect our cookie management vendor (below) to block non-essential cookies by default (with your option to grant consent via the cookie banner). Particularly given the limited amount and type of information and data collected through our Website, we may or may not have identified all possible uses, or restricted contractors’ or third party hosts/platforms own use or disclosure of information or data. We are not responsible for the conduct or policies of our contractors (or their subcontractors) or of third party hosts/platforms.

Retention of Personal Information

As a law firm, we are required by the Law Society of Ontario and our insurers to maintain specific personal information for some time for various reasons. However, KLC will not keep your personal information for any longer than is necessary to fulfil the purpose for which the personal information was collected, to comply with any legal, regulatory, or reporting obligations or to assert or defend against legal claims.

Transfer of Personal Information

We may store or process your data outside your city, province, state, or country, including through one of our contractors (described below). Your personal information may be stored in a jurisdiction that operates under privacy and data protection laws different from (and potentially less protective than) those of your home jurisdiction.

Disclosure of Personal Information

We may disclose, with your consent, personal information to third parties when we engage them in the course of providing you with legal services. KLC will not disclose more information than is reasonably necessary, which is disclosing your personal information. We will only disclose your personal information without your consent where it is permitted or required by law.

Protection of Personal Information

We protect your personal information and implement appropriate technical precautions and organizational security measures to protect such information.

We have an information security management system in place to protect your personal information, which protects our files and any information held within those files, accessible only through a password-protected virtual private network. All our employees, officers, and company members are trained only to collect and disclose personal information when necessary to fulfill our client’s needs and in accordance with this privacy policy statement. It is our duty, however, to bring to your awareness of potential risks when providing personal information through emails, text messages, fax messages and voice messages. Email, text messages, fax messages, and voice messages are not secure mediums, and you should be aware of this when contacting us to send personal or confidential information.

KLC uses multiple service providers to operate our business and provide you with legal services. Such services include but are not limited to, cloud-based practice management software, registry and information management service providers, government online or in-person registry systems, storage companies, couriers, process servers, search houses, building security, building management, and cleaners. These providers have limited access to certain personal information that is collected and must agree to protect your personal information in accordance with privacy policies similar to this one.

Data Privacy Laws

We provide this Policy describing the processing of personal information in the interest of transparency to users, including Website users. Doing so is not intended to suggest, and does not mean that, legal responsibilities apply to KLC that would not otherwise. Standards for personal information are not the same in all jurisdictions and are rapidly evolving and complex. Simply put, not all laws, including collection notice requirements, apply to all entities, individuals, or information, in all locations, or in all circumstances. Individuals in certain jurisdictions, inside and outside Canada, have certain rights when entities governed by those laws process their “personal data” or “personal information” (for example, pursuant to the European Union’s General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act (“CCPA”), and other international and U.S. State and federal laws, where applicable). (Depending on the jurisdiction, and subject to various limitations, such rights may include, for example, to access/obtain a copy, update/correct, or delete it; to object to/opt-out of certain processing (or not allow certain processing without consent); to complain to a data protection authority; entities which the CCPA defines as a “business” have special obligations to Californians including more detailed notices than this, and if personal information is “sold,” or “shared” (meaning for certain behavioral advertising) the opportunity to opt-out).

Amendment

You recognize that visiting the Website or using any other KLC services, does not restrict KLC’s rights to revise its terms and policies. KLC may change its Terms of Use and/or Privacy Policy at any time by posting a new version on this page or on a successor page. The new version will become effective on the date posted, which will be listed at the top of the page as the new Effective Date.
